1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the formbuild.io website, application, and related services (collectively, the "Service") operated by formbuild.io ("we", "us", or "our").

By creating an account or using the Service, you ("you" or "User") confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

• You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service.
• If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
• The Service is available to users in India and is governed by Indian law.

3. Account Registration

• You must provide a valid email address and create a password to register. You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information and to update it as necessary.
• You are solely responsible for all activity that occurs under your account. Notify us immediately at security@formbuild.io if you suspect unauthorised use.

4. Description of Service

formbuild.io provides a cloud-based form endpoint service that allows you to collect form submissions from your websites and applications without writing backend code. Features include a submission dashboard, email and chat notifications, integrations, analytics, team collaboration, spam protection, and data export.

5. Plans, Pricing, and Payments

• The Service is offered under Free, Pro, and Custom plans as described on the Pricing page. Feature limits and pricing may change; material changes will be notified at least 15 days in advance.
• All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise.
• Paid subscriptions are processed through Razorpay, a Reserve Bank of India (RBI) authorised payment aggregator. By subscribing, you also agree to Razorpay's Terms of Service.
• Subscriptions renew automatically at the end of each billing cycle (monthly or annual). You may cancel at any time from your dashboard settings; cancellation takes effect at the end of the current billing period.

6. Refund and Cancellation Policy

• You may cancel your subscription at any time. Upon cancellation, you will continue to have access to paid features until the end of the current billing cycle.
• Refunds are considered on a case-by-case basis. If you believe you are entitled to a refund, contact us at security@formbuild.io within 7 days of the charge.
• No refund is provided for partial months or unused features during an active billing period.

7. User Content and Data

• You retain all ownership rights in the data you submit to or collect through the Service ("User Data"). We do not claim ownership of your User Data.
• You grant us a limited, non-exclusive licence to process, store, and display your User Data solely to provide and improve the Service.
• You are responsible for ensuring that the data you collect through the Service complies with all applicable laws, including obtaining necessary consents from your end-users.
• You must not use the Service to collect Aadhaar numbers, financial account credentials, or any sensitive personal data (as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011) without implementing appropriate safeguards as required by law.

8. Privacy and Data Protection

Our collection, use, and protection of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

We comply with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 ("DPDP Act") to the extent applicable.

9. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Send spam, phishing content, or unsolicited communications.
• Distribute malware, viruses, or any harmful code.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Collect personal data of individuals without their informed consent.
• Use the Service for any activity that is illegal under the Indian Penal Code, the Information Technology Act, 2000, or any other applicable law.
• Interfere with, disrupt, or place an unreasonable burden on the Service or its infrastructure.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

10. Intellectual Property

• The Service, including its design, code, logos, trademarks, and documentation, is the intellectual property of formbuild.io and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
• You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.

11. Service Availability and Modifications

• We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We may modify, suspend, or discontinue any part of the Service at any time. Material changes will be communicated via email or in-app notification.

12. Limitation of Liability

To the maximum extent permitted by applicable law, formbuild.io and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims under these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or ₹5,000, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless formbuild.io, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party right.

14. Termination

• You may delete your account at any time by contacting us at security@formbuild.io.
• We may suspend or terminate your account if you violate these Terms or engage in activity that is harmful to the Service or other users.
• Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes, after which it will be permanently deleted.

15. Governing Law and Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of India.
• Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through amicable negotiation. If the dispute cannot be resolved within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Kolkata, West Bengal, India.
• Subject to the arbitration clause above, the courts of Kolkata, West Bengal shall have exclusive jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and formbuild.io with respect to the Service and supersede all prior agreements and understandings.
